Welcome to MAM Legal Services. These Terms of Use ("Terms") govern your access to and use of our website, services, and platforms. By accessing or using our services, you agree to be bound by these Terms. If you do not agree, do not use our services.

1. About MAM Legal Services

MAM Legal Services is NOT a law firm. We provide administrative and case operations support services for debt collection lawsuit defense matters. Legal services, legal advice, and legal representation are provided by independent licensed attorneys who partner with us.

Our services include intake coordination, document organization, deadline tracking, draft preparation support (for attorney review), client communication coordination, and case management operations. We do not provide legal advice, legal strategy, or legal representation.

2. No Attorney-Client Relationship

Using our website or services does not create an attorney-client relationship with MAM Legal Services. We are not your attorney and cannot provide legal advice.

If you engage an attorney through our partnership network, the attorney-client relationship is between you and that attorney, governed by a separate engagement agreement. MAM Legal Services provides operational support to facilitate that relationship but is not a party to it.

3. Eligibility and Account Registration

You must be at least 18 years old to use our services. By using our services, you represent that:

You are at least 18 years of age
You have the legal capacity to enter into binding agreements
All information you provide is accurate and complete
You will maintain the accuracy of your information

If you create an account, you are responsible for maintaining the confidentiality of your account credentials and for all activities under your account.

4. Services Provided

For Consumers (B2C)

We provide operational support services including:

Secure intake and document collection
Case file organization and deadline tracking
Draft preparation using attorney-approved templates (for attorney review)
Client communication coordination
Court filing coordination (documents signed by attorneys)
Discovery and hearing coordination
Settlement negotiation support

For Attorney Partners (B2B)

We provide managed case operations including:

Client acquisition and pre-screened lead generation
Complete case operations support
Case management platform access
Technology and automation tools
Quality control and compliance monitoring

5. Fees and Payment

Fees for our services vary based on jurisdiction, case complexity, and service package selected. All fees will be disclosed upfront before you commit to services.

Separate Attorney Fees: If you engage an attorney for legal representation, separate attorney fees apply and are governed by the attorney's engagement agreement. MAM Legal Services fees cover operational support only.

Payment terms:

Fees are due as specified in your service agreement
Payment plans may be available (inquire during intake)
All payments are processed through secure, PCI-compliant systems
Refunds are handled according to your service agreement

6. User Responsibilities

You agree to:

Provide accurate, complete, and timely information
Respond promptly to requests for information or documents
Meet deadlines and attend scheduled appointments
Communicate honestly and in good faith
Pay fees as agreed
Comply with all applicable laws and regulations
Not misuse our services or interfere with their operation

You agree NOT to:

Provide false or misleading information
Use our services for any unlawful purpose
Attempt to gain unauthorized access to our systems
Upload malicious code, viruses, or harmful content
Harass, abuse, or threaten our staff or partners
Violate any third party's rights

7. Intellectual Property

All content on our website and platforms, including text, graphics, logos, images, software, and design, is the property of MAM Legal Services or our licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not:

Copy, modify, distribute, or reproduce our content without permission
Use our trademarks or branding without authorization
Reverse engineer or decompile our software or systems
Create derivative works based on our content

8. Disclaimers and Limitations

No Guarantees of Outcome

We do not guarantee any specific outcome or result. Every legal case is unique, and outcomes depend on many factors including case facts, evidence, court decisions, and opposing party actions. Past results do not predict future outcomes.

Jurisdiction Limitations

Our services are currently available in select states. Availability of attorney representation depends on jurisdiction and attorney partner availability. We cannot guarantee attorney availability in all locations.

Technology Limitations

While we use AI and automation tools to improve efficiency, these tools are not perfect. All AI-generated content is reviewed by humans, and all legal documents are reviewed by licensed attorneys before filing.

Third-Party Services

We use third-party services (cloud storage, payment processors, communication tools). We are not responsible for the performance, availability, or security of these third-party services.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAM LEGAL SERVICES AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF OUR SERVICES.

OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so these limitations may not apply to you.

10. Indemnification

You agree to indemnify, defend, and hold harmless MAM Legal Services and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorney fees) arising out of or related to:

Your use of our services
Your violation of these Terms
Your violation of any third party's rights
Any false or misleading information you provide

11. Termination

We reserve the right to suspend or terminate your access to our services at any time, with or without notice, for any reason, including:

Violation of these Terms
Fraudulent or illegal activity
Non-payment of fees
Abusive or threatening behavior
Any conduct we deem harmful to our business or reputation

Upon termination, your right to use our services immediately ceases. Provisions that by their nature should survive termination (including disclaimers, limitations of liability, and indemnification) shall survive.

12. Dispute Resolution and Arbitration

Informal Resolution: Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at [email protected].

Binding Arbitration: If informal resolution fails, you agree that any dispute arising out of or related to these Terms or our services shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

Class Action Waiver: You agree to resolve disputes on an individual basis only. You waive any right to participate in class actions, class arbitrations, or representative actions.

Exceptions: Either party may seek injunctive relief in court to protect intellectual property rights or confidential information.
